These agency terms govern the contractual relationship between you as the guest (hereinafter referred to as the “Client”) and Balearian Hospitality Services S.L., Palma de Mallorca, Spain, operating under the brand The Balearian – Villas & Concierge (hereinafter referred to as “The Balearian”).

The Balearian arranges holiday accommodations in the Balearic Islands on behalf and for the account of the respective property owners.

By making a booking, you acknowledge and accept these agency terms.

1. Role of The Balearian
The Balearian acts exclusively as an intermediary and is neither a tour operator nor the landlord. The rental agreement is concluded directly between you and the respective property owner. Balearian Hospitality Services S.L. acts in the name and on behalf of the property owner and is authorised to receive bookings and payments and to forward them accordingly.

2. Booking and Conclusion of Contract
By submitting a booking request through The Balearian, you make a binding offer to conclude a rental agreement with the property owner. The rental agreement becomes effective upon booking confirmation issued by The Balearian. For bookings made through online platforms (e.g. Airbnb, Booking.com), the respective terms and conditions of those platforms apply in addition.

3. Payment Terms
For direct bookings through The Balearian, the following payment terms apply unless otherwise agreed: 30% deposit of the rental price upon booking confirmation Remaining balance due no later than 40 days prior to arrival For bookings made through online platforms, the respective payment and settlement conditions of those platforms apply exclusively.

4. Security Deposit and Damages
For direct bookings, a security deposit may be required. The amount and payment conditions are specified in the respective booking confirmation. The deposit is generally refunded within 14 days after departure. Deductions may be made for damages, missing cleaning services or extraordinary wear and tear. For bookings made via Airbnb, damage handling is carried out exclusively through Airbnb’s AirCover programme. AirCover is not an insurance product but a damage protection programme provided by Airbnb for hosts. A separate cash deposit may therefore be waived or reduced depending on the platform conditions.

5. Cancellation and Withdrawal
The applicable cancellation terms depend on the booked accommodation and the corresponding property group (e.g. Mallorca or Ibiza) as defined in The Balearian booking system (vOffice). The cancellation conditions displayed during the booking process, in the offer or in the booking confirmation within the booking system shall be decisive. For accommodations in the Mallorca property group, the following cancellation fees apply unless otherwise specified in the booking system, calculated on the agreed total rental price: up to 90 days before arrival 30%, 89–60 days before arrival 50%, 59–30 days before arrival 75%, from 29 days before arrival, in case of no-show or early termination 100%. For accommodations in the Ibiza property group, different cancellation conditions apply, which are specified in the booking system and generally require a deposit of 50% of the total rental price immediately after booking. In case of cancellation, the deposit paid is non-refundable unless otherwise stated in the booking system. Regardless of the property group, individual accommodations may be subject to different cancellation conditions determined by the property owner. In such cases, only the cancellation conditions specified in the booking system during the booking process shall apply. For bookings made through online platforms such as Airbnb, Booking.com or FeWo-Direkt, only the cancellation policies displayed on those platforms at the time of booking apply. These always take precedence over the cancellation conditions of The Balearian.

6. Services, Defects and Liability
The Balearian is responsible solely for the proper brokerage of the accommodation and not for the provision or quality of the accommodation itself. Any complaints or defects regarding the property must be reported immediately to the property owner or their local representative. The Balearian shall not be liable for service disruptions, damages or changes beyond its control, including but not limited to weather-related events, interruptions of utilities or actions of third parties.

7. Concierge Services and Additional Services
Additional services such as private chefs, catering, transfers, yacht charters, wellness services, housekeeping or experiences may be organised by The Balearian or arranged through selected professional third-party providers. We deliberately cooperate with experienced specialists who focus on their respective service areas and work with carefully selected partners. The contractual relationship for additional services is concluded directly between you and the respective service provider. The payment, cancellation and liability conditions of the respective provider apply. The Balearian assumes no liability for services provided by third parties but will gladly assist in coordinating and organising such services.

8. Data Protection
Balearian Hospitality Services S.L. processes personal data solely for the purpose of handling bookings and in accordance with the General Data Protection Regulation (GDPR) and the applicable Spanish data protection laws (LOPDGDD).

9. Property Information and Liability for Content
Images, descriptions, amenities and technical facilities do not constitute guaranteed characteristics unless expressly confirmed in writing. The Balearian, acting as an intermediary, assumes no liability for incorrect or modified information provided by the property owner or for resulting deviations, to the extent permitted by law.

10. Applicable Law and Jurisdiction
Spanish law shall apply exclusively. To the extent permitted by law, the place of jurisdiction shall be Palma de Mallorca.

11. Supplementary Spanish Legal Clause Cláusula de Derecho Aplicable (resumen en español): Este contrato se rige por el Derecho español. Cualquier controversia será sometida, en la medida legalmente posible, a los Juzgados y Tribunales de Palma de Mallorca. The Balearian acts exclusively as an intermediary (agent) and not as landlord or tour operator.
