General terms and conditions (AGB)
Our terms and conditions, also referred to below as brokerage conditions, govern the contractual relationship between you as a guest (hereinafter “Customer”) and The Balearian — Villas & Concierge, owner Florian Settele, Palma de Mallorca, Spain (hereinafter “The Balearian”).
The Balearian arranges vacation rentals on the Balearic Islands on behalf of and on behalf of the respective owners. By booking, you accept these booking conditions as binding.
1st role of The Balearian
The Balearian acts exclusively as an agent and is neither a tour operator nor a landlord.
The rental agreement is always concluded directly between you and the respective owner of the accommodation.
The Balearian acts on behalf of and for the account of the owner and is entitled to receive and forward bookings and payments.
2. Booking & conclusion of contract
By booking, you are making a binding offer to the owner via The Balearian to conclude a rental agreement.
The rental contract is concluded with the booking confirmation from The Balearian.
When booking via online platforms (e.g. Airbnb, Booking.com), the respective terms of use and contract of these platforms also apply.
3. Payment terms
For direct bookings via The Balearian, the following payment conditions apply, unless otherwise agreed:
30% deposit of the rental price upon confirmation of booking
Final payment no later than 40 days before arrival
When booking via online platforms, only their respective payment and billing conditions apply.
4. Deposit & damage
A deposit may be charged for direct bookings. The amount and payment terms are specified in the respective booking confirmation.
The refund is usually made within 14 days of departure.
Eligible withholdings in the event of damage, lack of cleaning or exceptional wear and tear remain reserved.
For bookings made via Airbnb, claims are processed exclusively via the AirCover program provided by Airbnb.
AirCover is not an insurance contract, but a claim cover for hosts. A separate cash deposit may be waived or reduced in these cases.
5. Withdrawal & cancellation conditions
The applicable cancellation and cancellation conditions depend on the accommodation booked and the associated property group (e.g. Mallorca or Ibiza), as stored in The Balearian's booking system (VOffice). Only the cancellation conditions shown in the booking system as part of the booking process, in the offer or in the booking confirmation are decisive. For accommodation in the Mallorca object group — unless otherwise stated in the booking system — the following flat rate cancellation fees apply, based on the agreed total rental price: up to 90 days before arrival 30%, 89—60 days before arrival 50%, 59-30 days before arrival 75%, from 29 days before arrival, in case of no-show or early cancellation 100%. For accommodation in the property group Ibiza has different cancellation and cancellation conditions, which are stored in the booking system and usually require a deposit of 50% of the total rental price immediately after booking. In the event of cancellation, the deposit paid is not refundable, unless otherwise stated in the booking system. Regardless of the property group, different cancellation and cancellation conditions specified by the owner may apply to individual accommodation. In these cases, too, only the conditions stored in the booking system and identified as part of the booking process are decisive. For bookings made via online platforms such as Airbnb, Booking.com or FeWo-direkt, only the cancellation and cancellation conditions shown there at the time of booking apply. These always take precedence over The Balearian's cancellation policy.
6. Services, Defects & Liability
The Balearian is only responsible for the proper placement, but not for the provision or quality of the accommodation service itself.
Any deficiencies or complaints about the accommodation must be reported directly to the owner or his local contact person immediately.
The Balearian is not liable for disruptions in performance, damage or changes that are beyond its control, in particular not for weather-related events, supply interruptions or measures taken by third parties.
7. Concierge services & additional services
Additional services such as private chefs, catering, transfers, yacht charters, wellness treatments, housekeeping services or experiences can be organized by The Balearian or arranged through selected, professional third-party providers.
We deliberately rely on experienced specialist providers who are fully specialized in their respective areas of service and experience working with certified, high-quality partners.
The contract for additional services is concluded directly between you and the respective service provider.
Its payment, cancellation and liability conditions apply.
The Balearian assumes no liability for services provided by third parties, but is happy to assist with coordination and organization.
8. Data protection
The Balearian processes personal data exclusively to process the booking and in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection laws (LOPDGDD).
9. Information about accommodation/liability for content
Illustrations, descriptions, features and technical equipment do not represent guaranteed features unless these have been expressly confirmed in writing. As an agent, The Balearian assumes no liability for incorrect or changed information provided by the owner or for any resulting discrepancies, to the extent permitted by law.
10. Applicable Law & Jurisdiction
Only Spanish law applies.
To the extent permitted by law, the place of jurisdiction is Palma de Mallorca.
11. Supplementary Spanish legal clause
Cláusula de Derecho Aplicable (summary in Spanish):
This contrato se rige por el Derecho Español. Cualquier controversy será sometida, en la medida legalmente posible, a los Juzgados y tribunales de Palma de Mallorca.
The Balearian acts exclusively as an intermediary (agent), not as an arrendador ni organizer of trips.
