Rental agreements (booking forms) that have already been signed keep the version of these terms that is attached to them. You will find that version in your booking form under “Read the general terms and conditions” and as an annex to the PDF of the signed agreement.
General terms and conditions (AGB)
These agency terms govern the contractual relationship between you as the guest (hereinafter referred to as the “Client”) and Balearian Hospitality Services S.L., Palma de Mallorca, Spain, operating under the brand The Balearian – Villas & Concierge (hereinafter referred to as “The Balearian”).

The Balearian arranges holiday accommodations in the Balearic Islands on behalf and for the account of the respective property owners.
By making a booking, you acknowledge and accept these agency terms.
1. Role of The Balearian
The Balearian acts exclusively as an intermediary and is neither a tour operator nor the landlord. The rental agreement is concluded directly between you and the respective property owner. Balearian Hospitality Services S.L. acts in the name and on behalf of the property owner and is authorised to receive bookings and payments and to forward them accordingly.
2. Booking and Conclusion of Contract
By submitting a booking request through The Balearian, you make a binding offer to conclude a rental agreement with the property owner. The rental agreement becomes effective upon booking confirmation issued by The Balearian. For bookings made through online platforms (e.g. Airbnb, Booking.com), the respective terms and conditions of those platforms apply in addition.
3. Payment Terms
For direct bookings through The Balearian, the following payment terms apply unless otherwise agreed in the offer, the booking confirmation or the rental agreement: a deposit of 30% of the rental price is due immediately upon reservation, and the remaining balance is due no later than 60 days before arrival. For bookings made through online platforms, the respective payment and settlement conditions of those platforms apply exclusively.
4. Security Deposit and Damages
For direct bookings, a security deposit may be required. The amount and payment conditions are specified in the respective booking confirmation. The deposit is generally refunded within 14 days after departure. Deductions may be made for damages, missing cleaning services or extraordinary wear and tear. For bookings made via Airbnb, damage handling is carried out exclusively through Airbnb’s AirCover programme. AirCover is not an insurance product but a damage protection programme provided by Airbnb for hosts. A separate cash deposit may therefore be waived or reduced depending on the platform conditions.
5. Cancellation and Withdrawal
Unless otherwise agreed in the offer, the booking confirmation or the rental agreement, the following cancellation fees apply, calculated on the agreed total rental price: up to 90 days before arrival 30%, 89–60 days before arrival 50%, 59–30 days before arrival 75%, from 29 days before arrival, in case of no-show or early termination 100%.
For bookings made through online platforms such as Airbnb, Booking.com or FeWo-Direkt, only the cancellation policies displayed on those platforms at the time of booking apply. These always take precedence over the cancellation conditions of The Balearian.
6. Services, Defects and Liability
The Balearian is responsible solely for the proper brokerage of the accommodation and not for the provision or quality of the accommodation itself. Any complaints or defects regarding the property must be reported immediately to the property owner or their local representative. The Balearian shall not be liable for service disruptions, damages or changes beyond its control, including but not limited to weather-related events, interruptions of utilities or actions of third parties.
7. Concierge Services and Additional Services
Additional services such as private chefs, catering, transfers, yacht charters, wellness services, housekeeping or experiences may be organised by The Balearian or arranged through selected professional third-party providers. We deliberately cooperate with experienced specialists who focus on their respective service areas and work with carefully selected partners. The contractual relationship for additional services is concluded directly between you and the respective service provider. The payment, cancellation and liability conditions of the respective provider apply. The Balearian assumes no liability for services provided by third parties but will gladly assist in coordinating and organising such services.
8. Data Protection
Balearian Hospitality Services S.L. processes personal data solely for the purpose of handling bookings and in accordance with the General Data Protection Regulation (GDPR) and the applicable Spanish data protection laws (LOPDGDD).
9. Property Information and Liability for Content
Images, descriptions, amenities and technical facilities do not constitute guaranteed characteristics unless expressly confirmed in writing. The Balearian, acting as an intermediary, assumes no liability for incorrect or modified information provided by the property owner or for resulting deviations, to the extent permitted by law.
10. Applicable Law and Jurisdiction
Spanish law shall apply exclusively. To the extent permitted by law, the place of jurisdiction shall be Palma de Mallorca.
11. Supplementary Spanish Legal Clause
Cláusula de Derecho Aplicable (resumen en español): Este contrato se rige por el Derecho español. Cualquier controversia será sometida, en la medida legalmente posible, a los Juzgados y Tribunales de Palma de Mallorca. The Balearian acts exclusively as an intermediary (agent) and not as landlord or tour operator.

These terms apply only to the welcome voucher we offer when you subscribe to our newsletter. They are separate from the terms and conditions above and do not change them.
1. Provider
The voucher is granted by Balearian Hospitality Services S.L. (The Balearian), Carrer d'Alber 64, 07008 Palma, Spain, CIF B26863035, info@thebalearian.com.
2. Who receives it
Adults who subscribe to our newsletter through the form on our website while it offers the welcome voucher, and who confirm their email address via the link in our confirmation email. Once you have confirmed, we show you the voucher code and also send it to you by email. Without confirmation, no voucher is issued.
3. Amount
The value depends on the booking value of the booking for which you redeem it: €50 from €5,000, €200 from €10,000, €500 from €25,000. The highest tier reached always applies automatically; tiers are not added together. The tier you choose when subscribing tells us your wishes and does not limit the voucher. The voucher cannot be redeemed for a booking value below €5,000. The booking value is the price of your stay in the property (rent, final cleaning and any additional services of the property that you book) after any other discounts and before the voucher is deducted, excluding the service fee, tourist tax and security deposit. Services from third parties that you arrange directly with the provider are not included.
4. Validity
The voucher is valid for 14 days. The period starts when you confirm your subscription and ends at 23:59 (Palma time) on the 14th day after the day of confirmation. We state the exact expiry date in the voucher email and on the confirmation page. Your enquiry must reach us by then. The booking must be confirmed no later than 30 days after the expiry date. After that, the voucher expires without replacement.
5. Redemption
Enquire through our website using the email address with which you subscribed, or quote the voucher code in your enquiry by email, telephone or WhatsApp. We deduct the voucher from the price in your offer and in the booking confirmation. Once a booking has been concluded, the voucher can no longer be redeemed for that booking.
6. Once per person
Each person receives the voucher only once, even if they subscribe again with further email addresses or after unsubscribing. One voucher may be redeemed per booking. The voucher is personal and not transferable. The person booking must be the person who subscribed.
7. Direct bookings only
The voucher applies only to bookings made directly with The Balearian. It does not apply to bookings via Airbnb, Booking.com or other platforms, nor to bookings that already existed when you confirmed your subscription.
8. No cash value, cancellation
The voucher is not paid out or refunded in cash or in any other form; any remaining value lapses. If the booking is cancelled, the voucher lapses. Cancellation fees are calculated on the price after deduction of the voucher.
9. Combination
The voucher can be combined with individual discounts in your offer and is calculated after them. It does not apply in addition to a price adjustment under our best-price guarantee.
10. Unsubscribing
A voucher that has been issued remains valid until its expiry date, even if you unsubscribe from the newsletter beforehand.
11. End of the promotion
We may end or change the promotion for future subscriptions at any time. Vouchers already issued remain subject to the terms that applied when you subscribed. In the event of misuse, such as multiple subscriptions under different addresses, we may refuse redemption.
